TERMS AND CONDITIONS
Orders will only be considered valid if the corresponding proforma invoice is returned with Customer’s stamp and sign.
2. LEAD TIMES
Lead times will be specified within each order’s corresponding proforma invoice. Any possible delay to the defined terms will not result in cancellation of the Order and will not allow for any requests in terms of damages or compensation to be made.
Transport costs will always be borne by the Client at his risk and peril, in accordance with Article 1093 of the Italian Civil Code. Any complaints for missing or damaged goods should be communicated immediately following to the receipt of the goods on the TRANSPORT DOCUMENT, countersigned by the driver. The reserve should be subsequently transmitted to Quiko Italy by means of an email within 3 days. Non-compliancy with the above-mentioned formalities will result in the decline of any compensating action.
Any complaints related to the quality and nature of the goods and/or the identification of any possible hidden faults should be sent to us by email within 8 days from receipt of the goods. In any case, no returns will be accepted without our specific written authorization.
Payment terms will be specified within each order’s corresponding proforma invoice. Costs related to any unpaid amount will be borne entirely by the Customer, as well as interest calculated by us in the event of delayed payments. The goods delivered will remain our property until total payment has been received. If the goods are duly resold, any resulting credit will be considered due to us. Bank fees and transaction costs will have to be borne by the Customer.
6. WARRANTY TERMS
Quiko Italy guarantees its products for a period of:
– 4 (four) years from the date of invoice for mechanics (gearmotors);
– 2 (two) years from the date of invoice for electronics (control boards, remote controls, photocells, etc..)
All items that will have been wrongly used, tampered or damaged by causes not depending on Quiko Italy will not be covered by warranty. Contested items, that on unchallengeable judgment of Quiko Italy will be considered as faulty, will be repaired or replaced by Quiko Italy without the responsibility of any direct or indirect damages caused. Warranty repairs will only be done in the Quiko Italy’s laboratories located in Via Seccalegno, 19 – Sossano (VI) Italy, whereas the Customer has to ship faulty item/s on his own risk/cost. The Customer will always have to send written notice to Quiko Italy prior to ship any faulty items. After receiving those items, Quiko Italy will evaluate whether they are covered by warranty or not. If they are covered by warranty Quiko Italy will replace them for free within the successive Customer’s order expedition. If they are not covered by warranty Quiko Italy will send to the Customer a proforma invoice showing cost for repair / replacement. After receiving the Customer’s written confirmation, Quiko Italy will repair / replace faulty items and will insert them within the successive Customer’s order expedition. Distributors are recommended to group faulty items and ship them back to Quiko Italy once a considerable quantity is obtained, so to save on shipment charges on each single item. For instance, Customer will ship a parcel of faulty items to Quiko Italy once or twice a year.
7. PLACE OF JURISDICTION
Any disputes arising under or in connection with this Sales Contract shall be finally settled by the court of Vicenza (Italy) and is ruled by the Italian law.
